The superior court of Hamburg decided with judgement on May 12th, 1998, that the person who places a link in the internet may be responsible for the contents of those linked sites.
According to §8 Teledienstegesetzes (TDG) the owner of a home page is responsible for an illegal content only if he has knowledge about the illegal contents. Explicitly there is no obligation or liability to search for illegal contents within the linked pages.
Whoever requests to link a site to our homepage obliges himself within the proposal for linking, that no illegal content whatsoever will be published on the linked pages.
